Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Agent GTM website at agentgtm.app (the "Site") and our go-to-market services (the "Services"). By using the Site or Services, you agree to these Terms. If you do not agree, do not use the Site or Services.
1. Acceptance of these Terms
By accessing the Site, submitting a form, booking a call, or otherwise using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you use the Services on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.
2. The Services
Agent GTM provides an AI go-to-market service that researches markets, builds verified account-and-people data, drafts outreach grounded in research, and runs email campaigns on your behalf. The Services are human-in-the-loop: outreach is prepared as drafts and is not sent without approval. We do not guarantee any specific number of meetings, replies, or business outcomes. Details of any paid engagement (including scope, fees, and add-ons such as managed LinkedIn outreach) are agreed separately in writing.
3. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Services. The Services are intended for business use.
4. Your responsibilities
- Provide accurate information and keep it up to date.
- Ensure you have the rights and permissions to share any materials, data, or contact information you provide to us.
- Comply with all laws that apply to your use of the Services, including marketing, anti-spam, and data-protection laws (such as GDPR, CAN-SPAM, and the UAE PDPL) in the markets you target.
- Keep any access credentials confidential and notify us of any unauthorised use.
5. Your content & materials
You retain all ownership of the decks, documents, data, and other materials you provide ("Your Content"). You grant Agent GTM a limited, non-exclusive, worldwide licence to host, store, process, and use Your Content solely to provide and improve the Services for you. You are responsible for the accuracy and legality of Your Content, and you confirm you have the necessary rights and consents to share it, including any personal data of third parties.
6. Acceptable use
You agree not to:
- Use the Services to send unlawful, deceptive, harassing, or unsolicited communications in violation of applicable law.
- Upload material you do not have the right to share, or that infringes the rights of others.
- Attempt to disrupt, probe, or gain unauthorised access to the Site, Services, or related systems, or interfere with their security.
- Reverse engineer, scrape, or misuse the Site or Services, or use them to build a competing product.
- Use the Services to process highly sensitive categories of data unless expressly agreed in writing.
7. Intellectual property
The Site and Services, including their software, design, text, graphics, and the Agent GTM name and logo, are owned by Agent GTM or its licensors and are protected by intellectual-property laws. Except for the rights expressly granted to you, no rights are transferred. You may not use our marks without our prior written permission.
8. Third-party services
The Services rely on third-party providers (for example, cloud hosting, storage, calendar, and email providers). Your use of those services may be subject to their own terms, and we are not responsible for third-party services or content.
9. Disclaimers
The Site and Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site or Services will be uninterrupted, error-free, or secure, or that any particular results will be achieved.
10. Limitation of liability
To the maximum extent permitted by law, Agent GTM and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Site or Services. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Site or Services will not exceed the greater of (a) the amounts you paid us for the Services in the three months before the event giving rise to the claim, or (b) USD 100.
11. Indemnity
You agree to indemnify and hold harmless Agent GTM from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Services, Your Content, or your breach of these Terms or applicable law.
12. Suspension & termination
We may suspend or terminate your access to the Site or Services at any time if you breach these Terms or to protect the Services or other users. You may stop using the Services at any time. Provisions that by their nature should survive termination (including sections 5, 7, 9, 10, 11, and 13) will survive.
13. Governing law & disputes
These Terms are governed by the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates, without regard to conflict-of-laws rules. The courts of Dubai, United Arab Emirates will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, except where mandatory local law gives you the right to bring proceedings elsewhere.
14. Changes to these Terms
We may update these Terms from time to time. We will post the revised version here with a new "Last updated" date. Your continued use of the Site or Services after changes take effect constitutes acceptance of the revised Terms.
